SwimKids ("SwimKids," "we," "us," or "our") operates swim lesson programs across Utah and this website at swimkidsutah.com. We know that when you enroll a child in swim lessons, you are trusting us with more than your family's schedule — you are trusting us with information about your child. This Privacy Policy explains what information we collect, why we collect it, how we use and protect it, and the choices you have.

By using our website, enrolling in a program, applying for a job with us, or communicating with us, you agree to the practices described in this policy.

1. Who This Policy Covers

This policy applies to information we collect through:

• Our website, swimkidsutah.com, including forms, chat, and online scheduling
• Our customer and parent portal, registration, and payment systems
• Email, text message, and phone communications with our team
• In-person interactions at any of our Utah swim locations
• Employment applications, our hiring and recruiting process, and communications with job applicants

Our website and services are directed to parents, guardians, and adults — not to children. Children do not create accounts, register themselves, or interact with our site directly.

This policy also applies to job applicants. When you apply for a position with SwimKids, we collect the information you provide in your application, such as your name, contact details, work history, education, certifications, and availability, along with information from interviews, references, and any background or screening checks we conduct where permitted by law. We use this information to evaluate your application, communicate with you about the role, and meet our recordkeeping obligations. We may keep your application on file to consider you for future openings, and applicant information is shared only with the staff involved in hiring and the service providers that support our hiring process.

2. Information We Collect

Information you give us

• Parent and guardian details: name, email address, phone number, mailing or billing address, and account login credentials.
• Swimmer details: your child's first and last name, date of birth or age, gender, swim level and progress, attendance, and instructor notes about skill development.
• Health and safety information: allergies, medical conditions, physical limitations, or other information you choose to share so we can keep your child safe in and around the water, plus emergency contact names and phone numbers.
• Authorized pickup information: names and contact details of people you approve to pick up your child.
• Payment information: billing name and address, and the last four digits and expiration of your payment card. Full card numbers and bank details are collected and processed directly by our payment processor — we do not store complete card numbers on our systems.
• Mobile number and messaging consent: the phone number you give us, whether you have consented to receive text messages from us, when and how that consent was given, and your opt-out requests.
• Communications: the content of emails, text messages, form submissions, reviews, and support requests you send us.

Information collected automatically

• IP address, browser type, device type, and operating system
• Pages viewed, links clicked, time on site, and referring website
• Cookies, pixels, and similar technologies used for site functionality, analytics, and advertising

Photos and video

We may take photos or video at our facilities, during lessons, and at events for instruction review, safety, staff training, and marketing. We ask for your consent before using an identifiable image of your child in public marketing, and you may withdraw that consent at any time by contacting us. Many of our pool areas also use video monitoring for safety and supervision purposes.

3. How We Use Your Information

We use the information we collect to:

• Register swimmers, place them in the right class level, and manage schedules and make-ups
• Process tuition, payments, refunds, and account balances
• Keep your child safe in the water and respond appropriately in an emergency
• Track and share your child's swim progress with you
• Send account notices, schedule changes, closures, reminders, and other service messages
• Respond to your questions and provide customer support
• Communicate with job applicants about their application, interviews, and onboarding
• Send promotions, newsletters, and program updates when you have opted in
• Improve our website, programs, and instruction
• Comply with legal obligations and enforce our policies

4. Children's Privacy

Protecting children's information is central to what we do. Our website is a general-audience site intended for parents and guardians. We do not knowingly collect personal information online directly from children under 13.

Information about a child in our records is provided to us by that child's parent or legal guardian during registration, or created by our staff in the normal course of instruction (for example, swim level and progress notes). We use children's information only to deliver and improve our swim programs and to keep swimmers safe. We do not sell children's personal information, and we do not use it for targeted advertising.

As a parent or guardian, you may at any time:

• Review the personal information we hold about your child
• Request that we correct or delete it
• Refuse to permit further collection or use of it, understanding that some information is necessary for us to provide lessons safely

To make any of these requests, contact us using the details in Section 12. We may ask you to verify your identity and your relationship to the child before acting on the request. If you believe a child under 13 has provided us information online without a parent's involvement, please contact us and we will delete it.

5. How We Share Information

We do not sell your personal information, and we do not sell your child's personal information.

We do not share mobile information or text messaging opt-in data with third parties or affiliates for marketing or promotional purposes. See Section 7 for full details on how mobile information is handled.

We share information only in these situations:

• Service providers. Companies that operate on our behalf, such as our class registration and scheduling platform, payment processors, email and text messaging providers, applicant tracking and recruiting tools, website hosting, and analytics services. They may use the information only to perform services for us.
• Instructors and staff. Our instructors and location managers access swimmer information as needed to teach classes safely.
• Emergency and medical responders. If a swimmer is injured or requires medical attention, we may share relevant health and contact information with first responders or medical personnel.
• Facility partners. Where we operate inside a partner facility, limited scheduling or access information may be shared with that facility.
• Legal and safety. When required by law, subpoena, or court order, or when we believe in good faith that disclosure is necessary to protect the safety of a child, our staff, or the public. Our staff are mandatory reporters under Utah law.
• Business transfers. If SwimKids is involved in a merger, acquisition, or sale of assets, information may transfer as part of that transaction, subject to this policy.

6. Cookies, Analytics, and Advertising

We use cookies and similar technologies to keep the site working, remember your preferences, understand how visitors use our pages, and measure the performance of our advertising. Some of these are set by third parties such as analytics and advertising platforms, which may use them to show you SwimKids ads on other websites.

You can control cookies through your browser settings, and most browsers let you block or delete them. Blocking some cookies may affect how parts of the site work. You can also opt out of many interest-based ads through industry tools such as the Digital Advertising Alliance's opt-out page or your device's advertising settings.

We do not use children's information for targeted advertising.

7. Text Messaging (SMS) and Mobile Information

Mobile information is never shared for marketing

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties or affiliates.

Information may be shared with subcontractors that support our messaging services, such as our text message delivery provider and our recruiting platform, solely so they can deliver the messages you have asked to receive. Those subcontractors are contractually restricted from using your mobile information for their own marketing and from selling or sharing it.

What messages you may receive

By providing your mobile number to SwimKids, you agree to receive text messages from us related to the reason you provided it. Depending on your relationship with us, that may include:

• Customer and account messages: class schedules, closures, make-up lessons, lesson reminders, billing and account notices, and replies to your questions.
• Recruiting and hiring messages: if you apply for a position with SwimKids, messages about interview scheduling, application status, onboarding steps, and shift or availability questions.
• Promotional messages: program news, session openings, and special offers, sent only if you separately opt in to marketing texts.

Frequency, rates, and how to opt out

Message frequency varies. Message and data rates may apply. Reply STOP to any message to stop receiving texts from that program, and we will send one confirmation message. Reply HELP for assistance, or contact us at 801-691-7946 or info@swimkidsutah.com. Carriers are not liable for delayed or undelivered messages.

Consent to receive text messages is not a condition of enrolling in swim lessons, purchasing anything from us, or being considered for employment. If you opt out of texts, we may still contact you by email or phone about essential account, safety, scheduling, or hiring matters.

You can unsubscribe from marketing emails using the link at the bottom of any marketing email. We will still send you essential service messages about your account and your child's classes.

8. How We Protect Information

We use reasonable administrative, technical, and physical safeguards to protect the information we hold, including limiting staff access to what each role needs, using reputable third-party platforms for registration and payments, and securing our website with encryption. No method of transmission or storage is completely secure, so we cannot guarantee absolute security, but we take this responsibility seriously and review our practices regularly.

9. How Long We Keep Information

We keep information for as long as your family is enrolled with us and afterward for as long as needed to run our business, resolve disputes, maintain safety and incident records, and meet legal, tax, and accounting obligations. We retain records of text messaging consent and opt-out requests for as long as required to document compliance. When information is no longer needed, we delete it or de-identify it.

10. Your Privacy Rights

Depending on where you live, you may have the right to:

• Confirm whether we process your personal data and request a copy of it
• Request correction of inaccurate personal data
• Request deletion of personal data you provided to us
• Opt out of the sale of personal data or targeted advertising
• Not be discriminated against for exercising these rights

Utah residents have these rights under the Utah Consumer Privacy Act. To make a request, contact us using the information in Section 12. We will verify your identity before responding and will reply within the timeframe required by applicable law. You may also make a request on behalf of your minor child.

11. Third-Party Links

Our site may link to other websites, such as our registration platform, review pages, or social media profiles. We are not responsible for the privacy practices of those sites, and we encourage you to read their privacy policies.

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date at the top of this page.
